1.Who we are

Paydude (“Paydude”, “we”, “us”, “our”) provides payment processing services and developer tools, along with this website and our waitlist. This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have.

This policy covers paydude.com, our APIs, dashboards, SDKs, and MCP server (together, the “Services”). It does not cover the practices of merchants who use Paydude to accept payments — when you buy something from one of our merchants, that merchant’s own privacy policy governs its use of your information.

2.Information we collect

We collect information in three ways: information you give us, information we gather automatically from your use of the Services, and information we receive from third parties.

Information you give us:

  • Waitlist details — your name, work email address, company name, and approximate monthly card volume.
  • Account and onboarding details — business name and address, tax identification numbers, bank account details for payouts, and identity information for the business owners and control persons we are required to verify.
  • Support and communications — the contents of emails, support requests, and any other messages you send us.

Information we collect automatically:

  • Usage data — pages viewed, features used, API endpoints called, timestamps, and referring pages.
  • Device and connection data — IP address, browser type, operating system, and device identifiers.
  • Cookies and similar technologies — see the Cookies and tracking section below.

Information we receive from others:

  • Identity verification, sanctions screening, and fraud-prevention providers.
  • Card networks, acquiring banks, and other financial institutions involved in processing a payment.
  • Our merchants, when they submit a transaction for processing on behalf of their customers.

3.Payment card data

Payment card numbers submitted through Paydude are transmitted over TLS and tokenized. We store card data only in the form and for the duration necessary to process transactions, handle refunds and disputes, prevent fraud, and meet our legal and card-network obligations.

We do not sell payment card data, and we do not use the card data of a merchant’s customers to market our own products to those customers.

4.How we use information

We use personal information to:

  • Provide, operate, and improve the Services, including processing payments, payouts, refunds, and disputes.
  • Create and administer accounts, and verify the identity of businesses and their control persons.
  • Detect, investigate, and prevent fraud, money laundering, and other prohibited or illegal activity.
  • Provide customer support and respond to your questions.
  • Send service messages, such as security alerts, changes to terms, and transaction notifications.
  • Send product and marketing email where you have asked to hear from us, such as by joining the waitlist. You can unsubscribe at any time.
  • Comply with legal, regulatory, tax, accounting, and card-network requirements.

Where the law requires a legal basis for processing, we rely on performance of a contract, our legitimate interests in operating and securing the Services, compliance with legal obligations, and — where applicable — your consent.

5.How we share information

We do not sell personal information. We share it only in the following circumstances:

  • Financial partners — card networks, acquiring and issuing banks, and payment processors, as necessary to complete a transaction.
  • Service providers — vendors that host our infrastructure, verify identity, screen for fraud, deliver email, and provide analytics, each bound by contract to protect the information and use it only for the services they provide us.
  • Merchants — where you are a customer of a Paydude merchant, we share transaction information with that merchant.
  • Legal and safety — when we believe disclosure is required by law, regulation, legal process, or a governmental request, or is necessary to protect the rights, property, or safety of Paydude, our users, or the public.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this policy continuing to apply to the transferred information.

6.Cookies and tracking

We use cookies and similar technologies to keep you signed in, remember your preferences, secure the Services against fraud and abuse, and understand how the site is used so we can improve it.

Most browsers let you block or delete cookies. Blocking cookies that are strictly necessary may prevent parts of the Services — such as signing in — from working. We honor Global Privacy Control signals where required by law.

7.How long we keep information

We keep personal information for as long as needed to provide the Services and for the periods required by law. Financial and transaction records are typically retained for at least five years after the end of the relationship, because financial regulations and card-network rules require it.

Waitlist information is kept until you ask us to remove it or until we determine it is no longer useful, whichever comes first.

8.Security

We protect information with encryption in transit and at rest, network isolation, least-privilege access controls, logging and monitoring, and regular security review of our infrastructure and code.

No system is perfectly secure. If we become aware of a breach affecting your personal information, we will notify you and the relevant regulators as required by applicable law.

9.Your rights and choices

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you and request a copy.
  • Correct information that is inaccurate or incomplete.
  • Delete information, subject to the record-keeping obligations described above.
  • Object to or restrict certain processing, and withdraw consent where processing is based on consent.
  • Opt out of marketing email at any time using the unsubscribe link or by emailing us.
  • Appeal a decision we make about a privacy request, and lodge a complaint with your local data protection authority.

To exercise any of these rights, email hello@paydude.com. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising a privacy right.

If your data was submitted to us by a Paydude merchant, we act as a service provider or processor for that merchant. Please direct your request to the merchant, and we will assist them in responding.

10.International transfers

Paydude operates in the United States, and information we collect may be transferred to, stored in, and processed in the United States and other countries where we or our service providers operate. Where required, we use approved transfer mechanisms such as the European Commission’s Standard Contractual Clauses to protect information transferred out of your region.

11.Children’s privacy

The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, email hello@paydude.com and we will delete it.

12.Changes to this policy

We may update this Privacy Policy as our Services and the law change. When we do, we will revise the “Last updated” date at the top of this page. If the changes are material, we will give you additional notice — for example by email or through the Services — before they take effect.
